West Clinton annexation
On Sept. 8 the Clinton City Council unanimously annexed about 155 acres near 2425 North and 4500 West, closing an unincorporated gap between Clinton and West Point. Three ordinances passed: the annexation itself (26-06), an agreement setting conditions for the land (26-07) and the initial zoning (26-01Z). Most of the land is zoned A-1 agricultural, one property in the northwest corner R-1-10 and one in the southwest R-M; the agreement bars apartments on the R-M parcel, requires wider side setbacks there and warns future buyers near farms about noise, odors and dust. Staff stressed the zoning does not approve a subdivision, density or site plan. A city staff report for the Oct. 13 work session describes the annexation as approved and in its final stages at the state level, so it is not yet clear that the state has certified it. That session also took up a proposed Clinton West Focus Area Plan, which would guide land use in the same part of the city.

Clinton West Focus Area Plan (general plan addendum)
Pending
Staff recommends approving the plan as an addendum to the general plan. It would set a future land use map for the northwest part of the city, largely the West Clinton annexation area. Staff says adoption would help it answer development inquiries and plan infrastructure. Consultant Psomas prepared an accompanying document with economic analysis and plans for surrounding areas.

Ordinance 26-06: West Clinton annexation
Approved
The ordinance annexes about 155.136 acres generally near 2425 North and 4500 West, closing an unincorporated gap. Mayor Marie Dougherty said the annexation had been discussed over several years in multiple meetings and hearings. She and City Manager Trevor Cahoon said Davis County has sought to eliminate isolated unincorporated areas and that Clinton already provides or is positioned to provide police, fire and utility services there. Councilmember Adam Larsen said he did not see a significant direct financial benefit but considered Clinton the logical city to serve the area. Staff recommended approval, saying the petition met the requirements.

Ordinance 26-07: annexation and land use conditions agreement
Approved
The agreement sets conditions for the annexed land, including that multifamily housing is prohibited on the Nilson parcel even though it is zoned R-M, larger side setbacks there, and notice to future buyers near agricultural property that farming came first and may bring noise, odors and dust. Mayor Dougherty read revised language for a screening fence along the north side of the public right-of-way into the record; the city had asked for a six-foot vinyl privacy fence, stronger than city code would normally require. The fence is not required until development and the obligation is to be carried into recorded covenants.

Ordinance 26-01Z: initial zoning for the West Clinton annexation area
Approved
The initial zoning map assigns A-1 agricultural zoning to most of the area, R-1-10 to the Lone Pine property in the northwest corner and R-M to the Nilson property in the southwest. Mayor Dougherty said annexed land enters the city with no Clinton zoning, so the council must assign one, and that the city cannot impose requirements beyond what is legally supportable. Staff stressed that the zoning does not approve a subdivision, final density, site plan, utility plan or other development application, which remain subject to later review; Cahoon said engineering, traffic and other review could reduce the number of units that can be built. Councilmember Dane Searle said he would have preferred a road connection to the south but considered the plan the best available option.
- Unanimous roll call
- Zoning approval is not a subdivision, final density, site plan or utility approval; those need later review
